These Terms & Conditions (“Terms”) govern your access to and use of solayae.com (the “Site”) and any purchases made through the Site. The Site is operated by Soláyae LLC (“Soláyae,” “we,” “us,” “our”), a California limited liability company.

By visiting the Site, browsing our collection, creating an account, signing up for notifications, or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

We may update these Terms from time to time by posting the revised version on the Site. Changes take effect when posted. We encourage you to review this page periodically. Your continued use of the Site after changes are posted constitutes your acceptance of the updated Terms.

 

GENERAL TERMS OF USE

Your use of the Site is subject to our Privacy Policy, which is posted separately and explains how we collect, use, and share personal information and how we use cookies and similar technologies.

Age requirement: The Site is intended for individuals 18 years of age or older. By using the Site or placing an order, you represent that you are at least 18 years old. If you are under 18, please do not use the Site.

 

All content on the Site, including product designs, photographs, images, videos, graphics, text, logos, trademarks, service marks, trade dress, and the overall look and feel of the Site (collectively, “Content”), is owned by Soláyae or our licensors and is protected by intellectual property laws.

Without our prior written permission, you may not reproduce, copy, publish, transmit, distribute, display, sell, license, or exploit any Content. You may not modify, adapt, translate, reverse engineer, or create derivative works from Content. You may not use “Soláyae” or any Soláyae marks, logos, or product imagery in any marketing, advertising, or materials that suggest affiliation or endorsement. You may not remove copyright, trademark, or other proprietary notices from the Site or Content.

 

We take great care to present accurate product descriptions and imagery on the Site. However, colors may appear differently depending on your screen or device settings.

Many Soláyae pieces are artisan-crafted using traditional techniques and natural materials. Minor variations in weave, texture, tone, pattern placement, and finishing are part of the handmade process and reflect the individuality of each piece. These characteristics are not considered defects.

Care and handling: Please follow any care instructions included with your product or posted on the Site. Damage caused by misuse, improper storage, exposure to moisture or heat, harsh chemicals, or abnormal wear may not be eligible for return, exchange, or remedy.

 

If you create an account on the Site, you agree to provide accurate information and to keep your login credentials confidential. You are responsible for all activity that occurs under your account. If you suspect unauthorized use, please notify us immediately at support@solayae.com.

We may suspend or terminate accounts that violate these Terms or that appear to involve fraud or misuse.

 

If you opt into notifications for an out-of-stock product, please note that the notification does not reserve the item and does not guarantee it will become available. We are not responsible for missed notifications due to spam filters, mailbox settings, carrier blocking, or similar issues. We may limit the number of active notifications per customer and may suspend access to this feature if we detect abuse.

 

When using the Site, you agree not to violate any applicable law or regulation, infringe the rights of Soláyae or others, interfere with Site functionality or security (including through hacking, scraping, bots, or malware), attempt to gain unauthorized access to accounts, systems, or data, or use the Site for fraudulent, abusive, or harmful purposes.

We may restrict, suspend, or terminate your access if we believe you have violated these Terms.

 

The Site may include links to third-party websites or services, including payment processors and shipping carriers. We do not control those third parties and are not responsible for their content, policies, or practices. Your use of any third-party service is at your own risk and is governed by that party’s own terms.

 

TERMS OF SALE

Purchases made through the Site are subject to these Terms and any additional terms displayed at checkout. The version of these Terms in effect at the time you place your order will apply to that transaction.

 

Soláyae products are sold for personal use only. Purchasing for commercial resale is prohibited. We reserve the right to limit quantities, refuse service, cancel orders, or restrict accounts if we suspect resale activity or order manipulation.

 

All prices are displayed in U.S. dollars unless otherwise stated. Applicable taxes and shipping charges are calculated and displayed at checkout before you complete your purchase.

 

Placing an order through the Site constitutes an offer to purchase. We may accept, decline, or cancel any order at our discretion, including for reasons such as inventory availability, suspected fraud, pricing or listing errors, or shipping limitations. If we cancel an order after payment has been captured, we will issue a full refund to the original payment method.

Order changes and cancellations: If you need to change or cancel an order, please contact us as soon as possible at orders@solayae.com. We will do our best to accommodate your request, but we cannot guarantee changes or cancellations once fulfillment has begun.

 

We accept the payment methods displayed at checkout. By submitting payment information, you represent that you are authorized to use the selected payment method. We may use fraud-prevention measures that could delay or prevent order fulfillment.

 

Soláyae currently ships within the United States only. Shipping options and availability are displayed at checkout. For full details on shipping methods, processing times, and delivery estimates, please refer to our Shipping Policy, which is posted separately on the Site.

Delivery times are estimates and are not guaranteed. Estimates may be affected by carrier delays, weather events, peak-season volume, or other circumstances beyond our control. We reserve the right to require signature confirmation for high-value shipments at our discretion.

Address accuracy: You are responsible for providing a correct and complete shipping address. If a package is returned to us due to an incorrect or undeliverable address, we may deduct the cost of reshipment from any refund where permitted by law.

 

To the extent permitted by law, risk of loss and responsibility for the shipment transfers to you when the carrier confirms delivery to the shipping address you provided, or when you or your authorized recipient takes physical possession of the package, whichever occurs first.

 

Returns, exchanges, and refunds are governed by our Returns & Exchange Policy, which is posted separately on the Site. If there is any conflict between these Terms and that policy, the Returns & Exchange Policy controls for return-related matters.

 

Promotions and discount codes may have specific restrictions and expiration dates, cannot be redeemed for cash, and may not be combined with other offers unless explicitly stated. Gift cards, if offered, are subject to additional terms presented at the time of purchase and applicable law.

 

LEGAL

To the maximum extent permitted by law, the Site and all products are provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. This disclaimer does not affect any warranties that cannot be excluded under applicable law.

 

To the fullest extent permitted by law, Soláyae will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, or goodwill, arising out of or related to the Site or any products purchased through it.

Where liability cannot be fully excluded, Soláyae’s total aggregate liability will not exceed the amount you paid for the specific product or products giving rise to the claim. Some jurisdictions do not allow certain limitations of liability; in those cases, the limitation applies to the maximum extent permitted by law.

 

You agree to indemnify, defend, and hold harmless Soláyae LLC and its owners, officers, employees, and agents from any claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, your misuse of the Site, or your violation of any law or third-party rights.

Informal resolution: Before initiating any formal legal action, we encourage you to contact us at info@solayae.com so we can try to resolve the matter directly. We will make a good-faith effort to address your concern within 30 days.

Governing law: These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where consumer protection laws require otherwise.

Venue: Any dispute arising out of or relating to these Terms, the Site, or any products purchased through it will be brought exclusively in the state or federal courts located in Riverside County, California, and you consent to personal jurisdiction in those courts.

 

If we do not enforce any provision of these Terms on a particular occasion, that does not waive our right to enforce it in the future.

 

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

 

These Terms, together with our Privacy Policy, Shipping Policy, and Returns & Exchange Policy, constitute the entire agreement between you and Soláyae regarding your use of the Site and any purchases made through it.
